The Justice Centre was established in response to a significant increase in Non-Molestation and Occupation Order applications submitted to the Court.
A considerable number of Respondents in these cases have been without legal representation, resulting in their voices often going unheard within the Family Court arena.
The launch of the Justice Centre aims to address this issue by ensuring that respondents are provided a fair trial and receive the necessary legal support to effectively present their case.
The Justice Centre offers assistance to respondents in preparing response statements. We provide comprehensive guidance on the various options available in court, such as contesting applications, offering undertakings, or exploring other legal remedies.
Additionally, the Justice Centre endeavours to secure Legal Aid for respondents through its network of solicitors.
Should a respondent not be entitled for Legal Aid, the Justice Centre will offer support and guidance to help them navigate the legal process as a litigant in person.
The Justice Centre is dedicated to providing respondents with precise legal guidance, ensuring they are well-informed about the applicable laws, necessary steps, and available measures.
Our commitment extends to safeguarding the respondents' rights, particularly under Article 6 of the European Convention on Human Rights, which guarantees the right to a fair trial, and Article 8, which upholds the right to respect for private and family life, as well as the sanctity of one's home and correspondence.
We recognise that respondents should not be left to navigate the complexities of legal proceedings on their own, as they may find it challenging to adequately defend themselves due to a lack of understanding of the legal process. The Justice Centre is here to ensure they receive the support and representation they need.
